Trumping Rule of Law: Executive order bypassing supreme court judgment

The Indian federal government has cleared the way for bullfighting events to resume in southern Tamil Nadu state, bypassing a Supreme Court ban. http://www.bbc.com/news/world-asia-india-38705616

# this is interesting. Executive order bypassing supreme court judgment. It appears to be happening everywhere, from Bangladesh and India to the United States of America. The day before yesterday there was a discussion in BBC television regarding this matter. Commentators stated that President Obama used this executive power often to overcome conservative obstacles put by the USA Republican party in issues such as climate change. People overlooked the fact that in helping the good cause of climate change mitigation President Obama undermined the rule of law by taking recourse of the executive order where he does not need the approval of the legislature in that case. Now President Trump has already started to take full advantage of the avenue opened by good intentioned President Obama. Soon, we anticipate, he will be bypassing both the legislature and the judiciary.

This is a worrying trend for rule of law. Executive orders do not go through the rigorous process of scrutiny and consultation of a law passed by the Parliament. It does not go through the rigorous process of discourse of a judgment. Such elaborate and rigorous process of scrutiny removes the harmful parts of any decision. Executive decisions are therefore dangerous for the society. It is dictatorship in the garb of democracy.

The Indian Supreme Court should come forward very soon to rectify its position in the light of the constitutional framework. If the popular decision is in favor of the sport than they should reconsider their decision. Laws are not enacted by aliens for the benefit of the aliens. Laws are in effect majority decisions of the population.

A US appeals court has rejected President Donald Trump's attempt to reinstate his ban on visitors from seven mainly Muslim countries.

The 9th US Circuit Court of Appeals said it would not block a lower-court ruling that halted the order.

It also rejected the argument that the president had sole discretion to set immigration policy.

"Rather than present evidence to explain the need for the executive order, the government has taken the position that we must not review its decision at all," said the ruling. "We disagree, as explained above.'' Reports BBC

Rohingya Refugee Dil Mohammed tells his stories: Rohingyas are starving at Kutupalong Refugee Camp, Bangladesh

Rohingya people of the Myanmar have started arriving as refugees to Bangladesh in the early 1990s. They are still arriving in great numbers.


The last big arrival was caused by the atrocities that took place in October 2016, ohchr.orgCNNtime.combbc.com



These refugees who arrived following the last wave of atrocities in October 2016 have received very little or no any assistance from the UNHCRIOM, the Government of Bangladesh or any other organization.



They are starving. Living in dismal conditions, suffering from injuries inflicted by the Myanmar Military.



They desperately need help from the international community.

In this video Rohingya Refugee Dil Mohammed tells me that he arrived at this Camp 10/15 days ago. When they were attacked, they left the home at once, there was no time even to close the doors. He could not bring any money with him, not even the clothes, he tells me.

He arrived by walking through the hilly forests that separates Myanmar and Bangladesh. It was horrible, he tell me. His entire family could not come with him. Some of his children are still behind, but they are alive, he  says.

They are eight now in his family in Kutupalong Camp. He did not receive any help, food or otherwise, from any body yet. He does not know if any help is given at the Camp by the Govt. or by any NGOs. he received no information.

I told him that many NGOs have their offices at the nearby Kutupalong Bazar. Did he try to get any help from there? He said he tried once or twice, but could not get through the big crowd of people there. He adds that he felt embarrassed to look for food from people. He was a well to do farmer in Myanmar.

I asked him if the refugees who came earlier are helping the newcomers with information. He said no. I had a volunteer with me who is also a Rohingya refugee who came some months ago. He confirmed that there is no such organized effort among the old refugees in the Camp to help the new comers with information. 

This is important because although these Rohigya people speak a distant dialect of Bengali, their language quite different from the language of the local population. Besides, they do not know the locality, or the governance structure of Bangladesh. They are also in severe distress.

No Govt. or non-Govt. organization came to register him as a refugee.

He and his family are going through severe hardships. The night before our conversation the family had boiled rice with a green chilli chatni. They had no food that day up to the time when we had the conversation, around 12.55 pm.

In reply to my question Sikander, a Rohingya Refugee who came 10/15 days earlier said there is no other place to build a hut around here. The hills are the only place not occupied by the Bangladeshi people. Sikander told me that he is now living in his relative's hut. His relatives are also refugees in this Camp who came earlier. His relatives are also paying for his hut, which is being built behind him. He does not whether the Government of Bangladesh is providing any food or other help. Nobody gave him any information.

In this video wee numerous new makeshift huts built on hillsides. 

This Refugee, Sirajul Islam, tells me that his house in Myanmar was burnt by the Military.

He received 25 Kilograms rice from the Government of Bangladesh. He does not know if there will be more help later. He was not registered as a refugee at the Camp, no paperwork whatsoever was done. He collected the rice in exchange of a token which was given earlier by a 'Majhi', a community leader, in the Camp.

No body gave him any information regarding how he may register himself as a refugee so that he may receive more assistance. His fellow refugees are themselves in great distress, he tells me, and are unable to help.

In the last part of this video clip we see a refugee opened a tiny shop on a table top catering for other refugees. He is selling lozenges, biscuits, carbonated bottled drinks etc.

We distribute some rice among the newly arrived refugees. One refugee shows me his broken leg in braces. Military broke his leg with a rod, he says. He treated the broken leg with brace in Bangladesh. He did not receive any medical assistance from any body in this Camp.

প্রতিবেশীর হকঃ জেনেভা ক্যাম্প ও কড়াইল বস্তিতে গুলশান ও ধানমণ্ডি বাসিদের কর্তব্য

তিনদিন আগে আমার ব্লগে আমি লিখি গুলশানের পাশের কড়াইল বস্তি এবং ধানমন্ডির পাশের জেনেভা ক্যাম্পের মানুষদের ভালোমন্দ এক সুতোয় গাঁথা। গুলশানের এবং ধানমন্ডির মানুষরা তাদের গরীব প্রতিবেশীদের ভালো মন্দের খোঁজ খবর না রাখলে একসময় নিজের সীমানার পাশে উৎকট বৈষম্য ও দারিদ্র বেড়ে উঠতে দেয়া তাদের অভিশাপে পরিণত হবে। সৌদি আরব যেমন ইয়েমেনে পর্যুদস্ত হচ্ছে তেমন।

জেলাপ্রশাসন থেকে মাসে মাথাপিছু তিন কেজি গমের বরাদ্দ থাকলেও 2003 সাল থেকে তা বন্ধ রয়েছে। 42 হাজার বর্গফুট এলাকায় সাড়ে পাঁচ হাজার পরিবারের প্রায় 40 হাজার মানুষ বাস। 8 ফুট দৈর্ঘ্য ও 8 ফুট প্রস্থের ঘরে 10 থেকে 12 জন মানুষের বাস। ঘরের অন্ধকার দূর করতে সারাক্ষন বাতি জ্বালিয়ে রাখতে হয়। রান্না মাটির চুলায়। 40 হাজার মানুষের জন্য শৌচাগার মাত্র দেড়শ।

ক্যাম্পের অধিকাংশ বাসিন্দাদের জাতীয় পরিচয়পত্র রয়েছে। প্রশ্ন ওঠে সবার তা নেই কেন?

ক্যাম্পের অধিকাংশ মানুষই দিন মজুর। কেউ রিকশা চালায়, কেউ ঠেলা গাড়ী। কেউ মুচি, নাপিত, ধোপা, কসাইয়ের কাজ করে। তরুণরা ওয়ার্কশপে, ইলেকট্রিক, ইলেকট্রনিক্সের কাজ করে। কেউ কাপড়ে জরির কাজ করে।

আমরা ধানমন্ডি নিবাসীদের আহবান জানাই আপনারা আপনাদের প্রতিবেশী জেনেভা ক্যাম্প পরিদর্শন করুন, ওদের দুঃখ কষ্টের ভাগিদার হউন। আপনাদের যাকাত ফিতরা ওদের দান করুন।

গুলশানের অধিবাসীদের আহবান জানাই আপনারা কড়াইল বস্তি পরিদর্শন করুন, ওদের দুঃখ কষ্টের ভাগিদার হউন।

Discrepancy in the 7th Five Year Plan FY 2016-2020: Forest cover of 20% or 15%?

At Section 6.5 DEVELOPMENT RESULTS FRAMEWORK (DRF) FOR MONITORING THE SEVENTH FIVE YEAR PLAN (2016-2020) the 7th FYP sets a target to achieve 15% percentage of land covered by forestry with 70% tree density in 2010, the last year for the implementation of the Plan. (Section 6.5 DEVELOPMENT RESULTS FRAMEWORK (DRF) FOR MONITORING THE SEVENTH FIVE YEAR PLAN (2016-2020), Part 1, Chapter 6: MONITORING AND EVALUATION.)

But this target is stated to be 20% in the Forestry Sector Master Plan (1995- 2015) at Part 2, Chapter 4 Section 4.5, Forestry Sub-sector.

Why it is 15% in 2020 here?

The following explanation is provided: "The development vision of the forestry sub-sector is to expand forest resources of the country for maintaining ecological balance and sustainable economic growth. In Forestry Sector Master Plan (1995- 2015) a target was fixed to achieve 20 percent forest coverage by the end of 2015. But now it is clear that it is not achievable at all because in a land scarce country like Bangladesh there is hardly any scope to spare additional lands for forestry except newly accreted chars in the Bay of Bengal. "

This rationale and this whole statement of the 7th FYP is in direct contradiction with the Vision 2021 and also the rest of the 7th FYP.

The Table 2.1: 7th Five Year Plan Targets in Context in the Environmental Sustainability category contains at Item, No. 50, 'the target of Productive Forest Coverage (%) (70 % tree density) in the country'. The Table states that the forest coverage with 70% tree cover was 13% in the Base Year 2010, the Vision 2021 sets the target at 20%, the Progress under 6FYP 2015 was 13.14% and the 7th 2020 FYP sets the target at 20%.

Also, at Section 8.3 KEY OBJECTIVES UNDER THE 7THFYP, the FYP states the following:

"To achieve tree cover over 20% of the land surface (with tree density > 70%) and ecologically healthy native forests are restored and protected in all public forest lands (about 16% of land):

1. Ensure greater contribution of the forestry sector in the economic development
2. Strengthen forestry extension activities to transfer improved technology and research information to end-users, e.g., local people and private homesteads
3. Expand forest resources, make the forests adequately productive
4. Conserve Sundarbans mangrove forest without any further deforestation and forest degradation.
5. Develop institutional capabilities including human resource and involve local people as much as possible in forestry activities
6. Develop capacity of national government and regional/local offices to map and analyse land use through data-driven approaches/GIS
7. Further promote the people oriented programmes covering forestry on marginal lands, char lands, road sides, etc.
8. Ensure no forest land shall be converted for non-forest use.
9. Ensure no commercial plantation in protected forest area where only native species for enrichment and restoration purposes can be undertaken.
10. Ensure all PA management shall be inclusive of and respectful to the rights of the forest dwellers.
11. Consider out-sourcing forest protection measures, utilizing community members on the ground as forest stewards.

Why is this discrepancy in the country's most important planing instrument, the 7th Five Year Plan? Why was the statement at Section 6.5 added?

Thousands suffer from acute drinking water crisis in Patiya.

পটিয়ার চারটি গ্রামে নলকূপে পানি উঠছেনা বলে সেখানকার প্রায় চল্লিশ হাজার বাসিন্দাদের জলকস্ট হচ্ছে। গত চব্বিশ বছরে এই এলাকায়  অপরিকল্পিত শিল্পায়নের ফলে ভুতলের পানি অধিক ব্যবহার হয়েছে তাই এখন নলকূপে আর পানি উঠছেনা।

এ বিষয়ে বাংলাদেশ পরিবেশ আইনজীবী সমিতি বেলা গত 2015 সালে হাইকোর্টে একটি রীট মামলা করে। কোর্ট গত 29 জানুয়ারী 2015 তারিখে আটটি কারখানাকে ভুতলের পানি উত্তোলন করতে নিষেধ করে। স্থানীয়রা অভিযোগ করে শুধু বনফুল মিনারেল পানি কারখানা উত্তোলন স্থগিত করে, কিন্তু অন্য শিল্প গুলো উত্তোলন অব্যাহত রাখে।

26 নভেম্বর 2016 তারিখে আদালত জনস্বাস্থ প্রকৌশল অধিদপ্তরকে বর্তমান অবস্থা সম্পর্কে একটি প্রতিবেদন তৈরি করতে আদেশ দেয়। কিন্তু অধিদপ্তরটি এখনো কোনো প্রতিবেদন আদালতে দাখিল করেনি বলে জানান বেলা প্রধান নির্বাহী সৈয়দা রিজওয়ানা হাসান। আমরা এলাকাটিকে জলকষ্ট বা ওয়াটার স্ট্রেসড এলাকা বলে ঘোষণার দাবি করে আদালতে দরখাস্ত করেছি, কারণ যদি তা করা হয় তবে এলাকার জলব্যবহার আইনে নির্ধারিত অগ্রক্রম অনুসারে নির্ধারিত হবে, যথা পানীয় এবং গৃহস্থালির ব্যবহার্য পানির ব্যবহার অগ্রাধিকার পাবে।

ইয়েমেন বিস্ময়

জানা গেলো 2024 সালে স্বল্পোন্নত দেশ থেকে উন্নয়নশীল দেশে উত্তরণ ঘটবে বাংলাদেশের, সাথে জিবুতি ও ইয়েমেন। জাতিসংঘের বাণিজ্য ও উন্নয়ন সম্মেলন গত মঙ্গলবারে প্রকাশিত এক প্রতিবেদনে এ কথা বলেছে। খবর দি ডেইলি স্টার।

তাজ্জব কথা, ইয়েমেন স্বল্পোন্নত দেশ? তা কি করে সম্ভব? আরব উপদ্বীপে সকল দেশ অসম্ভব রকম ধনী। এরা সপ্তাহের সাত দিন ব্যবহারের জন্য সাতটি ভিন্ন রঙের অতি মূল্যবান গাড়ি গ্যারেজে রাখে, বহুমূল্য দৌড়ের ঘোড়া কিনে, নাইটক্লাবে ডলার নোটের বৃষ্টি ঘটিয়ে আনন্দ লাভ করে।

সেই আরব উপদ্বীপে একটি দেশ স্বল্পোন্নত থেকে যায় কি করে?

বিশেষ করে সৌদি আরবের পাশের দেশটি, যে দেশের সাথে ইসলামের প্রথম যুগের বহু স্মৃতি জড়িত। সৌদি আরব রূপকথার রাজ্যের মত ধনশালী দেশ। তার দেয়ালের অন্য পাশে এই ঘটনা কি করে ঘটে?

আজ সৌদি আরব ইয়েমেনে এক রক্তক্ষয়ী যুদ্ধে জড়িত। এতে তার নিজের দেশের রক্তক্ষরণ ও কম হয়নি। যুদ্ধের বিপুল ব্যয় ও তেলের মূল্যহ্রাস মিলে সৌদি আরব ধনী হওয়ার পর এই প্রথম আর্থিক দুশ্চিন্তায় পড়েছে। দেশে জঙ্গি হামলার পথ খুলেছে। দেশে বিদেশে অসম্মান ও নিন্দা জুটেছে।

সৌদি আরব যদি আগে তার সীমানার পাশের দেশটির সাথে সুসম্পর্ক রাখতো, সেখানে বিনিয়োগ করতো আমেরিকার বন্ড না কিনে, শিল্প কারখানা গড়ে কর্মসংস্থানের ব্যবস্থা করতো, দান খয়রাত করতো, বেড়াতে যেত তবে ইয়েমেনের অর্থনীতি স্বল্পোন্নত হয়ে থাকতোনা। আর সৌদি আরবকে আজকের এই ব্যয়বহুল যুদ্ধ করতে হতোনা।

দরিদ্র প্রতিবেশী বিপজ্জনক। দারিদ্র একটি ঝুঁকি, পভার্টি ইজ এ হ্যাজার্ড। দেশের সীমানার ঠিক অন্য পাড়ে এই নিরাপত্তা ঝুঁকি তৈরি হতে দেয়া অতি নির্বুদ্ধিতার পরিচয়। এতে গোলযোগ হওয়ার ষোলআনা সম্ভাবনা। আল্লাহ পাক তাই বলেছেন ক্ষুদ্র ফিৎনা ইবাদত, দান আর সদ্ব্যবহারে মিটে যায়। সৌদি আরব তা করেনি, আর তাই আজ ফিৎনা গ্রাস করেছে তার দেশকে।

মহানগরীয় নদী সুরক্ষা কমিটি গঠন

সরকার রাজধানী ঢাকা নগরীর চারটি নদী ও চট্টগ্রামের কর্ণফুলী নদীর দূষণ রোধ ও নাব্যতা বৃদ্ধির লক্ষ্যে একটি মহাপরিকল্পনা প্রণয়নের জন্য একটি কমিটি গঠন করেছে। কমিটি আগামী তিন মাসের মধ্যে একটি খসড়া পরিকল্পনা দাখিল করবে। প্রয়োজনে তারা একটি কারিগরী কমিটি গঠন করবে। খবর দি ডেইলি স্টার, 16 ডিসেম্বর 2016.

.... কমিটিতে কারা আছেন তার বিবরণ দেয়া হয়নি। সম্ভবত সরকারের কিছু কর্মকর্তা থাকবেন সেখানে যাদের এ বিষয়ে কোনো ধ্যান ধারণা নেই। কমিটি গঠন কি কোনো প্রশাসনিক আদেশের মাধ্যমে হয়েছে? তাহলে বাংলাদেশে গেজেটে সেই আদেশ পাওয়া যাবে, আর তাতে এই কমিটির আইনগত ভিত্তি কি, তাদের দায়িত্বের স্বরূপ জানা যাবে। সরকারের প্রজ্ঞাপিত আদেশ ছাড়া এরকম গণ দায়িত্ব অর্পণ করা সম্ভব নয়। সুস্পষ্ট আইনি ভিত্তি ছাড়া কমিটির কাজ করা কঠিন হবে। কারণ পরিকল্পনা প্রণয়নের জন্য তাদের গণশুনানী, আলোচনা, পরিদর্শন করতে হবে এবং তাদের পরিকল্পনার ভিত্তিতে গৃহীত কার্যক্রম মানুষের অধিকার, সম্পদ ও স্বাধীনতা আক্রান্ত করবে।

এ বিষয়ে প্রজ্ঞাপিত আদেশটি খুঁজে বের করতে হবে।
